Local Government Regulation 2012
This is a Sales Notice for the land described in Schedule One by Negotiation under section 144 of the Local Government Regulation 2012 (‘the Regulation’).
On the 24th January 2023, Rockhampton Regional Council resolved under section 140(2) of the Regulation to sell the land described in Schedule One for overdue rates and or charges, and delegated the power to the Chief Executive Officer to take all further steps under Chapter 4, Part 12, Division 3 of the Regulation to effect the sale of the land or to end the sale procedures if deemed appropriate.
On 2nd February 2023, a Notice of Intention to Sell the land described in Schedule One for overdue rates and or charges was issued under section 140 of the Regulation and an Auction was conducted on the 21st June 2023 under sections 142 and 143 of the Regulation.
You are hereby notified by Rockhampton Regional Council that the land described in Schedule One is for Sale by negotiation under section 144 of the Regulation.

- Please note that the property can be removed from sale once a sufficient offer has been received.
- A cash deposit equal to 10% of the total purchase price is payable on signing of the contract. Payment of monies to be made either in legal tender, by electronic payment, or by a bank cheque issued by any bank carrying on business in Queensland under the laws of the Commonwealth of Australia in the State of Queensland.
- The seller gives no warranty as to the State of the Land, not its compliance under regulatory codes, legislation, or any other authority. The Seller recommends that purchases undertake due diligence & searches as they see fit to satisfy themselves.
- The Seller is unable to authorise inspections of the property, or any entrance thereon. The Seller gives no warranty as to current occupation of the state of the property in any respect.
- The Seller reserves the right to withdraw the Land from sale at any time before actual sale without declaring the reserve price.
- Please ensure you have sufficient identification to sign the contract. All representatives of the Buyer must have the ability to sign the contract and must be able to provide proof of their identity and authority. In the case of a corporate Buyer, all relevant signatories must be present together with the required company seal if necessary. If a company, please ensure you have you're A.C.N. details. In the case of a trustee Buyer, all relevant signatories must be present together with the producing of a copy of the trust deed which grants them authority.
- Subject to the terms of the Contract of Sale, the Seller and the Buyer agree to do all necessary act and to sign all documents and papers for the purpose of transferring the said land and property to the Buyer.
